Bahrain’s Criminal law is designed to protect people, including minors, and it has initiated imprisonment of up to three years for those who swindle a minor to rob their money.
This is indicated in article 392 in Bahrain Penal Code, which stipulates that (they are punishable by imprisonment those who exploit the need of a minor, or under interdiction or ruled to have continuous guardianship, or exploit the minor’s lack of experience, or caused harm to their interest or money, or led to the cancellation of a stock or change it. So, if the crime is committed by the guardian, this is considered an aggravating condition, and it is supposed that the offender has previously known about the minority of the victim, or the continuation of guardianship or trusteeship, unless they prove their ignorance of that truth.
On the other hand, this criminalization protects the minor from being financially exploited by those who know that they minors do not have experience and they are still very young. Therefore, the Bahraini legislator found out that it is not sufficient enough that the civil law terminates any of such acts, but the legislator approved such criminal article.
This crime is concerned with three elements (The state of the victim, that they have to be minors, the material element which is related to seizing the opportunity of the need or weakness of the victim (the Minor) and the result which is concerned with the defendant gaining any profits related to money which leads to harming the financial interest of the minor, and the financial element which is concerned with harming the victim in the form of criminal intent.
This element is represented by the act committed by the crime, and it means seizing the need or weakness of the minor to exploit their funds in unjust way. This leads to the disability of the minor to satisfy their legitimate life needs like food, education, and accommodation.
The law stresses the punishment if the crime is committed from the guardian, or those who have authority on the minor, and therefore the Bahraini Penal Code highlighted the need to protect the minor’s rights, as well as the rights of the young.
Bahrain and Singapore review ties
State Minister for Foreign Affairs Ghanim bin Fadhl Al Buainin met Singaporean Foreign Minister K. Shanmugam, on the sidelines of the 11th ministerial meeting of the Asian Cooperation Dialogue, which convened in Dushanbe, Tajikistan.
He stressed Bahrain’s keenness to further boost relations of friendship with Singapore for the best interest of both countries and people.
Both sides also discussed the latest regional and international developments.
